How to behave in the case of a road accident??

 

Step 1

  • Stop your car in such a way that it does not pose a danger for yourself or other road users.
  • Take measures in order to ensure traffic safety in the place where the accident has happened. In particular, mark the place of the incident with an emergency triangle.

Step 2

Find out if there are any injured persons or fatalities.

If there are not any injured persons or fatalities (minor road accident)

If there are injured persons or fatalities (Road accident)

  • Move the vehicle from the incident site if it hinders traffic, even if the Police had been summoned. *
  • Upon request of the other participant of the incident, give him/her your personal details, data of the owner of the vehicle and of the insurer you have closed your third party insurance with. 
  • Draw up a report about the incident which shall be the basis for the claim for the third party insurance. Use a ready-made form or prepare the report yourself. In the latter case remember that it must include:
    • data of the persons involved in the accident,
    • data of the vehicles,
    • name of the insurer, full number of the third party insurance Policy and its validity period,
    • detailed description of the sequence of events,
    • draft of the accident,
    • description of the damage to the vehicles,
  • If possible, take a few photographs of the place of the collision and of the damaged vehicles, e.g. using your mobile phone.

 

* whoever blocks or hinders traffic on a public road or in a residential area is liable to a fine or chastisement.

 

Legal basis

Article 90 act from 20.05.1971, Petty Offences Code.

  • Do not take any steps which might hinder ascertaining the course of events.
  • Switch off the engines in all damaged vehicles.
  • Instantly give first aid to the injured persons *, starting with the most gravely harmed , in particular with those who need CPR. More about the principles of providing first aid.
  • Summon rescue services and the Police, informing of:
    • he place of the event,
    • number of people injured,
    • state of the injured persons.
  • Remain at the place of the accident until the Police arrive.

 

* One who denies help to a person being in circumstances posing an immediate danger to their life or threatening serious medical impairment, while being capable of rendering it without exposing oneself or another person to a danger of loss of life or serious health impairment, is liable to the custodial punishment of up to 3 years.

Submit your claim to the insurer.
